The U.S. Becomes the First to Make Animal Cruelty a Federal Felony

The United States became the first nation in the world to treat animal cruelty as a federal felony.

For many people who care deeply about animals, this legal recognition felt like something that should have happened much earlier. For years, advocates, rescuers, veterinarians, and ordinary citizens argued that the law needed to reflect the reality of what severe abuse truly means. For law enforcement officials, it also underscored a well-documented concern: the clear connection between animal abuse and violence toward humans, as well as the role animals can play in broader criminal enterprises used to generate illegal profit.

Animals cannot explain what has been done to them, cannot report their suffering, and cannot ask for protection in the same way people can. Because of that, every legal step toward stronger accountability carries enormous emotional weight, reflecting not only punishment for the worst acts, but a statement about what a society is willing to tolerate—and what it refuses to excuse.

That shift came in 2019 with the passage of the Preventing Animal Cruelty and Torture (PACT) Act, which made certain extreme acts of intentional animal cruelty a federal felony. The law allows federal prosecution and penalties of up to seven years in prison for specific violent acts against animals. It also applies to offenses occurring on federal property or involving interstate commerce, giving authorities a broader reach than ever before in addressing severe abuse and activities such as dog fighting.

Prior to the PACT Act, animal cruelty cases were primarily handled at the state level. While all 50 states now have felony animal cruelty laws, definitions and penalties vary widely. Most focus on companion animals such as dogs and cats, though some extend protections to birds, horses, and other species. This inconsistency meant that enforcement and outcomes often depended heavily on geography, with some cases receiving strong prosecution while others were treated far less seriously.

The PACT Act built upon earlier federal law, which had only addressed narrow issues, by creating a far more comprehensive tool for confronting extreme violence against animals.

Federal guidance highlights that animal cruelty is a multifaceted issue, with animal fighting—particularly dogfighting—recognized as one of the most serious and widespread forms of abuse in the country. These cases are often linked to broader criminal activity, including drug trafficking, weapons violations, and money laundering, making coordinated enforcement especially important.

While the United States is now a leader in elevating animal cruelty to the federal level, many other countries have long-standing animal welfare legislation as well.

Even so, the PACT Act is widely regarded as a significant milestone in strengthening federal criminal justice responses to the most severe forms of abuse.

Ultimately, the law represents more than a legal update. It reflects a growing national understanding that extreme cruelty toward animals is not a minor offense, but a serious crime deserving of meaningful accountability.

It also signals a broader cultural shift—one that recognizes animal suffering as something that matters within the justice system, and not something to be overlooked or minimized.

Ultimately, for animal lovers and advocates, this change holds deep significance. It was not the conclusion of the effort to protect vulnerable animals, nor did it erase the ongoing challenges of preventing neglect, cruelty, and exploitation.

However, it did represent meaningful progress—a visible step forward after years of advocacy and concern. It reflected an increasing recognition that how animals are treated speaks to the ethical standards of a society as a whole.

And for those who had long called for stronger protections, it served as a reminder that progress, even when slow to arrive, is still possible and still matters.
